Please read these Terms and Conditions carefully before using the Present My Case platform. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please do not use the platform.

1. About Us

Present My Case is a division of Aflu Med Healthcare, a South African entity. We operate a legal research and case preparation platform designed to help individuals understand their legal situations and organise their facts using publicly available South African legal information.

2. Nature of Our Service

We are not a law firm, and we do not provide legal advice. The information, research packs, and guidance provided through our platform are for informational and educational purposes only. They do not constitute legal advice, nor do they establish an attorney-client relationship.

We strongly recommend that you consult with a qualified attorney or legal professional before taking any legal action or making decisions based on the information provided by our platform.

3. User Accounts

To use certain features of the platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

4. Free Case Quota

Each registered user is entitled to one free case per calendar month. This quota resets on the first day of each month. Once your free case has been used, additional cases require payment as described in our Pricing section.

5. Payments

Additional cases beyond the free monthly quota are charged at the rate displayed on our Pricing page (currently R500 per case). All prices are in South African Rand (ZAR) and include VAT where applicable.

Payments are processed through our secure payment gateway (Yoco). By making a payment, you agree to the terms of the payment provider. We do not store your full payment card details.

Due to the digital nature of our research packs, all sales are final. Refunds will only be considered in exceptional circumstances and at our sole discretion.

6. User Content

When you submit information about your case through our platform, you retain ownership of that content. However, you grant us a licence to use, store, and process that information solely for the purpose of generating your research pack and improving our services.

You warrant that any information you provide is accurate to the best of your knowledge and does not infringe on the rights of any third party.

7. Intellectual Property

All content on the platform, including but not limited to text, graphics, logos, software, and the design and layout of the site, is owned by or licensed to Present My Case / Aflu Med Healthcare and is protected by South African and international intellectual property laws.

The legal case law, legislation and guidance referenced in our research packs are sourced from publicly available, verified South African legal sources — including SAFLII, the Constitutional Court, the Supreme Court of Appeal, gov.za, the Department of Justice, Parliament, the CCMA, the Information Regulator, the SA Human Rights Commission, Legal Aid SA, and accredited academic law faculties. All citations are fact-checked against an allow-list of these sources before being shown to you. The underlying judgments and legislation remain in the public domain; our original analysis, summaries, and presentation are our intellectual property.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Present My Case, Aflu Med Healthcare, and their directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform or the information provided.

This includes, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.

9. Indemnity

You agree to indemnify and hold harmless Present My Case, Aflu Med Healthcare, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or your violation of any rights of another.

10. Termination

We may suspend or terminate your access to the platform at any time, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.

Upon termination, your right to use the platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our platform after those revisions become effective, you agree to be bound by the revised terms.
